صورت دعوی
فشرده جریان قضیه: مسمات بتول با غلام حضرت
شوهرش دعوی حقوقی و فامیلی داشته که اوراق در سارنوالی مبارزه با خشونت علیه زنان
لوی سارنوالی بوده که در نتیجه اوراق به حقوق ولایت کابل می رود که اوراق به محکمه
محول گردید که محکمه در مورد موضوع حقوقی شان تصمیم می گیرد که پارچه ابلاغ ضم
اوراق می باشد.
بخش جزایی قضیه به سارنوالی، کمیته متفرقه سپر
ده می شود. در جریان تحقیق چنین بر می آید که سارنوالی اختصاصی مبارزه با خشونت
علیه زنان طی مکتوب (26) 14- 1- 1391 خویش اوراق ادعای لت و کوبی مسمات بتول به
مظنونیت غلام حضرت ولد خادم علی را که تحت کار کمیته موظف تحقیق قرارداشته در
جریان تحقیق غلام حضرت طی ورقه عرض خویش علیه مسمات بتول عنوانی مقام لوی سارنوالی
ارایه داشته که مقام محترم لوی سارنوالی صاحب چنین احکام ارشاد فرموده: اوراق قضیه
برعکس خشونت علیه مرد است، قضیه مکمل بررسی شود. موضوع حقوقی و جزایی آن تفکیک، به
ریاست حقوق کابل ارسال گردیده درمورد جزایی مسمات بتول تحت جلب قرار داده شده که
بالاثر استعلام 23- 2- 91 مدیریت مبارزه با جرایم حوزه سوم شهر کابل و نظر به
هدایت مقام محترم ریاست سارنوالی استیناف
زون غرب سارنوال صاحب احمد فرید در قضیه گرفتاری مسمات بتول توظیف گردیده بود.
مسمات بتول موظفین پولیس را که به منظور احضاریت موصوفه در حضور داشت نماینده
سارنوالی به محل رفته بودند به تمام موظفین به شمول نماینده سارنوالی مورد توهین و
تحقیر از طرف بتول گردیده و دشنام داده شده اند که از طرف هیات محضر توهین و تحقیر قرار می گیرد که محضر توهین،
تحقیر و دشنام به امضا چندتن از پولیس ونماینده سارنوالی ترتیب گردیده است. به
رویت اوراق مسمات بتول یک شخص ماجراجو بوده و به قانون اعتنا نداشته که حتی موظفین
را به تاریخ 25- 2- 91 مورد توهین و تحقیر و دشنام قرار می دهد. بنابراین مسمات
بتول درمورد توهین و تحقیر و دشنام کسب
الزامیت نموده، طبق ماده 294 قانون جزای کشور قابل مجازات می باشد و از محکمه
محترم خواهشمند تا نامبرده را طبق ماده پیش بینی شده مجازات نمایند.

Complaint
Summary of case: Mrs. Batul and her
ex-husband, Ghulam Hazart, have legal suit and family suit. Their required
documents were sent to attorney general of violence against the women. After
required inquiries the documents were sent to Huqoq of Kabul city. The office
sent the case to court where the office solved the legal suit. The notice is
attached, too.
Criminal suit is sent to Committee of miscellaneous crimes. After inquiries
it was cleared that the attorney general of counter violence against the women
has been working on the indictment of Batul daughter of Qurban against Ghulam
Hazrat in effect of letter No (26)/14/1/1391. In judicial hearing the Ghulam
Hazart submit an indictment against the Batul in the attorney general office.
The attorney general orders that the law suit is against the man (the Ghulam
Hazart). So the case should be assessed completely.
Legal suit and criminal suit were
separated. Legal case was sent to Hoqoq of Kabul city. In criminal suit
According to inquiry letter (issued in 23/2/1391) of sub-directorate of counter
against criminal crimes of 6th district and due to the attorney
general office Mohammad Farid, attorney general, was assigned for arrest of Batul.
She insulted the police in presence of representative of attorney general. Thus
judicial delegations submit an indictment against her claiming disrespect of
the Batul. The complaint is added to the documents.
Following the required enforcements, the
office has assigned the case to Committee of miscellaneous crimes. The judicial
registry statement was written after of primary related document. The judicial
document was based on disrespect and intimidation of authorities by the Batul.
The attorney general and some security authorities has singed under the indictment.
The arrest notice has signature and signs!
According to us (inquiry delegation) the
Batul is stupid person and she has not any respect of code and regulations. She
has insulted the security staff on 25/2/1391.
When the 6th district authorities of Kabul city and attorney
general ‘s representative were assigned to enforce the code, they were
insulted.. So its requested that the Batul be punished according to the article
No (294) of the penal code.
